1. Acceptance of Terms

By accessing or using AI Gateway ("the Service") at https://ai.hopeagrico.com, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service.

2. Description of Service

AI Gateway provides a unified API gateway that enables access to multiple AI language models through a single endpoint. The Service includes API access, a developer dashboard, usage analytics, and related tools.

3. Account Registration

  • You must provide accurate and complete information when creating an account.
  • You are responsible for maintaining the confidentiality of your credentials.
  • You must be at least 16 years old to use the Service.
  • One person or entity may not maintain more than one free account.
  • You must notify us immediately of any unauthorized use of your account.

4. API Usage and Rate Limits

Your API usage is subject to the rate limits and quotas associated with your pricing tier. We reserve the right to throttle or suspend API access if you exceed your plan limits, engage in abuse, or use the Service in a way that negatively impacts other users.

5. Credits and Payments

  • The Service uses a credit-based billing system. API calls consume credits based on the model and tokens used.
  • Credits are non-transferable and non-refundable unless required by applicable law.
  • Free tier credits are a one-time allocation and do not roll over.
  • Subscription plans renew automatically at the start of each billing cycle.
  • We reserve the right to modify pricing with 30 days' advance notice.

6. Acceptable Use

You agree not to use the Service to:

  • Generate content that is illegal, harmful, abusive, or violates the rights of others
  • Attempt to reverse-engineer, exploit, or circumvent security measures
  • Resell or redistribute API access without authorization
  • Use automated tools to abuse rate limits or overwhelm the Service
  • Transmit malware, viruses, or other malicious code
  • Impersonate others or misrepresent your affiliation
  • Use the Service to develop competing products or services
  • Violate any applicable laws or regulations

7. Intellectual Property

The Service, including its design, code, and documentation, is owned by AI Gateway and protected by intellectual property laws. Your API outputs are generated by third-party AI models and are subject to those providers' terms. You retain ownership of your original inputs.

8. Service Availability and SLA

We strive to maintain 99.9% uptime but do not guarantee uninterrupted service. We may perform scheduled maintenance with reasonable advance notice. Enterprise customers may have separate SLA agreements.

9. Limitation of Liability

To the maximum extent permitted by law, AI Gateway shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenue, whether incurred directly or indirectly. Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim.

10. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied. We do not warrant that the Service will be error-free, uninterrupted, or that AI outputs will be accurate or suitable for any particular purpose.

11. Termination

We may suspend or terminate your access to the Service at any time, with or without cause, with or without notice. Upon termination, your right to use the Service ceases immediately. You may also delete your account at any time from the dashboard settings.

12. Modifications to Terms

We reserve the right to modify these Terms at any time. Material changes will be communicated via email or a prominent notice on the Service. Continued use after changes take effect constitutes acceptance of the updated Terms.

13. Governing Law

These Terms are governed by and construed in accordance with applicable laws. Any disputes arising from these Terms or the Service shall be resolved through good-faith negotiation first, then binding arbitration if necessary.
